These General Terms of Use (hereinafter referred to as “Terms of Use”) aim to determine the terms of use of the QWADRA website, accessible at: https://www.qwadra.com (hereinafter referred to as the “Site”).

The use of the qwadra.com website as well as the services offered therein implies the full, complete, and unconditional acceptance of these Terms of Use, without this acceptance being conditioned by a handwritten signature from the User. These terms of use are subject to unilateral modification or addition at any time; therefore, users of the qwadra.com website are invited to regularly review them.

In case of non-acceptance of these Terms of Use, the User must refrain from accessing the Site.

This Site is normally accessible to users at any time. However, an interruption for technical maintenance reasons may be decided by the webmaster, who will then endeavor to communicate the dates and times of the intervention to users in advance.

Given the sensitivity of this data, the User implements, at their own responsibility, all useful and relevant security measures for the protection of access to the services concerning them.

The QWADRA company grants the User a personal right to use the Site, Content, and Services, which is non-exclusive, revocable, non-transferable, non-transferable, free, and only for their own needs in the context of using the Site and Services, to the exclusion of any other purpose.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, by any means or process whatsoever, is prohibited.

The User acquires no intellectual property rights over the Site, Content, and/or Services, nor any rights other than those conferred by these.

The User expressly agrees that their use of the Site will not in any way infringe the rights of the QWADRA company, and in particular that this use will not constitute an act of counterfeiting, unfair competition, or parasitism of the Content.

7. Limitation of Liability

Access to and use of the Site are at the User’s own risk and peril, and it is their responsibility to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any infringement.

The User acknowledges and accepts the characteristics and limitations of the Internet network, including the functional characteristics and technical performance of the Internet network; problems related to connection and/or access to the Internet network; problems related to the availability and congestion of networks; problems related to network failure or saturation; problems related to access to information posted online, response times to display, consult, query, or otherwise transfer data; risks of interruption; lack of protection of certain data against possible diversions, etc., for which the QWADRA company cannot be held responsible.

The QWADRA company cannot be held responsible for:

be interrupted.

The Qwadra company cannot in any case be held responsible for any damage, of any nature whatsoever, caused to the User, their terminals, their computer equipment, and the data stored therein, nor for the consequences that may result for their personal, professional, or commercial activity.

8. Personal Data Protection

The User is informed that Personal Data (including administrative data) may be collected and processed as part of their use of the Site’s Services, notably through the forms available on the Site.

The information collected on these forms is recorded in a computerized file by Luc Boronat, CEO of QWADRA, for marketing and commercial purposes.

The User may access their data, rectify it, request its deletion, or exercise their right to limit the processing of their data. The User exercises this right by email at dpo@rodin4d.com.

The QWADRA company, as soon as it becomes aware of the expression of any of these rights by the User, must respond to the User’s request within one month.

By using the services offered by the Site, the User acknowledges that they voluntarily provide data, which remains their property. These Terms of Use grant no rights to the QWADRA company over this data.

The data is kept for the duration strictly necessary for the achievement of the aforementioned purposes and will correspond to the legal deadlines for the conservation of accounting and commercial documents by companies.

The Site implements organizational, technical, software, and physical measures in terms of digital security to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely protected environment, and the Site cannot guarantee the security of the transmission and storage of information on the Internet.

9. Hyperlinks and Cookies

10. Applicable Law and Jurisdiction

Any dispute relating to the use of the Site is subject to French law. Exclusive jurisdiction is given to the competent courts of Bordeaux.
